Winnipegger convicted of importing coral rock, sea horses

WINNIPEG is 2,000 kilometres away from the nearest ocean, but that didn't stop a local man from trying to build his business through the black-market aquatics industry.
Jason Daeninck, the owner of Salt Water Connection on Henderson Highway, was convicted Friday of smuggling protected coral rock, sea horses and giant clams into the city from Indonesia.
The case is believed to be the first of its kind discovered in Manitoba.
Daeninck was found guilty of 18 charges under the federal Wild Animal and Plant Protection and Regulation of International and Interprovincial Trade Act, through both his personal name and business. He will return to court early next year for sentencing, where he faces potential fines in excess of $1 million plus the possibility of jail time.
Daeninck was arrested in 2007 after Canada Customs intercepted a shipment of more than 9,000 kilograms of scleratinia rock at a port in British Columbia. The rare type of rock is protected because it contains coral. It can only be imported or exported if an international permit is obtained, which wasn't done.
Investigators linked the shipment to Daeninck and got a warrant to search his home and business on Henderson Highway.
They learned Daeninck had been involved in other illegal shipments of sea horses and giant clams, which are protected by the same regulations.
None of the protected items were recovered; officials believe they were brought into Canada and then sold on the black market. It's unknown exactly how many made it into the country.
Daeninck fought his case at trial, claiming he had ordered another type of rock that didn't contain coral for the purpose of building a fence in Winnipeg, like one he'd seen on a visit to Indonesia. Daeninck claimed there must have been a mistake in the order and he wasn't responsible.
Provincial court Judge Ray Wyant rejected his version of events Friday, calling it "meek and unbelievable." He said the fence-building story is laughable, considering the type of rock Daeninck claims he was truly trying to obtain would likely not have withstood the rigours of a cold Prairie winter.
"He was playing fast and loose with the international importation of protected species," Wyant said.
"He'd have us believe, for no reason whatsoever, a supplier in Indonesia sent him things he didn't order. He's not a neophyte when it comes to these matters. He knew exactly what he was doing. Any suggestion he ordered something else is a sham."
Wyant said it's clear Daeninck was trying bolster his own business and "play with the big boys" by bringing in items that would be considered the Holy Grail for black-market buyers.
Investigators also uncovered evidence, largely through seized emails, that Daeninck was involved in creating duplicate sets of invoices to dupe customs officials about the true nature of some of his shipments.
"This was an attempt to come up with a well-concocted explanation in case he got caught," Wyant said.

You will notice half this guys (RedDAWWWGGGGGGG) posts are somehow related to vendor bashing. This could very well be true but I just wanted to point that out.

Sad to hear vendors are up to things like this, if this is indeed true. SWC are the skimmers, right? That's where I recognize the name.

SWC are exceptional, and affordable skimmers. Yes, unfortunately, it is true. There are articles on several Canadian newspapers. While this is "reef news," let's not turn it into a vendor bashing thread. Keep to the events at hand. I'll admit that I feel that this negativity, in the media, no matter how deserved, will strengthen those who'd like to see our hobby shut down.
 
Please feel free to quote any post I have made that bashes a vendor, I have asked a few pertinent questions in a few threads (with no clarification from any vendor, one thread was actually locked by the admin of this site).
asking for clarification or pointing out discrepancies is not bashing. SWC skimmers have a fairly good reputation and my post is a direct article from a legitimate news source, and has no bearing on the quality of said skimmers. My sole purpose was to bring this to the attention of possible fellow hobbyists that may have warranty or parts concerns regarding SWC, I doubt this even made page 40 news in the US.

He wasn't charged, He was convicted! Looks like the SWC will soon be the Delorean of skimmers.
 
Well, all of the above isn't good news and i don't condone any of the above actions. I would say that swc isn't going anywhere and the "charges" are not nearly what they are saying. Its crazy what some paperwork can screw up. I think people think he was illegal harvesting from protected areas which is not true. He just had inadequate paperwork for the goods he imported. I got nothing on the excuse and who knows what is really true.

Main point is there is not going to be any warranty issue's and swc is not going anywhere. I wonder how many importers have done the same and not gotten charged.

On another note its funny to see the 07 threads brought back to life from the same people on all the diff forums : )
 
Luke, as an incredible sponsor, who carries SWC products, you were the first person I thought about, when I heard this, concerned about how this may effect you. Hopefully, it'll have no negative impact on you. One note though, as far as I know, this isn't about him being charged, but actually convicted. I do think that the penalty will be greatly reduced, from the potential 1 million dollar fine/ 1 year in jail, when it all comes down to it.
 
Yea man, its not a good thing for me! But on another note all warranty issue's have always gone through me so nothing changes there. Its definately an unfortunate incident but life goes on.

Great to hear you are standing up for the products your selling (one of the few retailers that would,most will direct you to the manufacturer). I have no direct experience with SWC other than what I read here and on other forums, some have related troubles with SWC directly on warranty issues. Too often in this hobby people pump up manufacturers and retailers and vilify anyone who asks sensitive questions. If SWC does go under due to this, how do you foresee the availability of parts in the future? Will you or someone else take over importing these skimmers?
 
I have warrant the skimmers from the beginning. If swc went under, which isn't going to happen. But let's say they did, I would import them directly. I am the only and oldest swc dealer that does this. I value every customer and feel I go above and beyond at times.

That's great to hear, like I said I have no interests in this either way. This wasn't posted here yet, and I posted to develope a discussion about it. If everyone had purchased from you the reputation of SWC wouldn't have so many negative opinions from people.
 
I have often recommended SWC skimmers but will stop since reading this. I don't want to support a company with this type of leadership, these are the type of people that are literally ruining our hobby.
 
I used a 250 extreme for a few years and loved it. This is a shame. Hopefully he sells the skimmer production off to pay part of the fine and someone keeps offering it. I think Luke should buy the skimmer production end off of him...:wink:
 
I am confused? the company he ordered from didnt have a CITES permit? if that is the case it is his own fault!
anyone can import anything as long as the company you are ordering from has the permit
if you are ordering from shady company's that dont have these permits you should be thrown in jail!
any reputably wholesaler will have the permit guaranteeing the ethical collection and proper care is given to the corals/fish.

sounds to me like this guy got what he deserved
 
And people wonder why out hobby is underfire, its headlines like this. He should go to jail and also never be able to work in the industry again.
 
Shipment get seized all the time, thats not newsworthy, but the statement that he wanted the live rock to build a fence! LOL I dunno if I love him or think hes nuts for thinking of that one LOL.....
