I am on the verge of shutting off all my phones!!!
For the past year I receive daily calls from the SAME COMPANY~ Brandy Wine LLC, a NON GOVT affiliated debt "reduction" company.
I have my number on the DNC list and I have repeatedly talked to the "supervisors" about removing my number. It is now to the point where I have every alternate number they used in my caller ID and I have begun toying with them when they call me when I am not doing anything.
I have documented as much as I can in accordance with junkbusters.com and the state laws on Telemarketing.
@$500 per violation if Indiana State Laws they have the following possible charges building up daily.
Each WILFUL violation is 3x more!
Each time they call me with Recorded messages that is a fine.
If I talk to a person and tell them I am not interested and they call again, each call is a fine, plus the additional fine for a recorded message per call.
The Telephone Consumers Protection Act allows me to act on these annoying attacks on my cellular phone.
According to The act, I am in a position of great advantage. The law states that I am in the right to send the CEO of the company a Demand Letter stating my issue, how much money I am trying to claim for the damages they have done on my behalf, and that I am willing to negotiate the price. (How much harm do phone calls really cause you). Well if the CEO is not stupid they WILL give you what you want. After 30 days if they do not then small claims court will take more money from them than you would have, they would also have to pay THEIR lawyer and Court costs, PLUS your full settlement. You do not need an attorney in small claims court either, and if you did need one for some reason they would be paying him, not you.
This is a very extreme option for getting back at telemarketers and SHOULD ONLY BE UTILIZED when you are finally tired of prank answering when they call.
You can also use the money to fund your reefing addiction, but try not to make a full time job out of it :)
