got into a fender bender

I was in a fender bender recently, around 1am I pulled into an apartment complex, couldn't get in the gate but luckily a car pulled up behind me and said it will open the gate, I had to make 3 lefts to get directly behind his car but I made 2 being that the left wouldn't allow me to be behind his car due to the gate opener being kinda far back. So at this point in sitting to make the left turn back into the complex with my signal on I looked right to sew of anything was coming g but there was the biggest ball of bushes ever blocking my view but not her view I seen so after I couldn't see anything I instantly tried to look for headlights didn't see any so I proceeded slowly under 10mph for sure and I almost made the turn successfully but as soon as I started to straighten my wheel I look to the left of me and its a red car drives into my side fender like where the fender and bumper of the car met https://imgur.com/FqJLeaR (this is my car) it pushed in that part and few scratch marks on the front bumper so my reaction was to brake and she braked on the side of me

I also feel like she is at fault because of her angle she could clearly see me coming and I was put in front of her and she didn't stop or brake slowly to let me finish making my turn

I want to get my car fixed as soon as possible because I don't like driving a messed up car but my insurance wants me to pay my deductible is that a good idea I don't want them to be like oh well he paid his deductible and fixed the car he must be at fault or whatever any advice of what to do now?

Did anyone get a ticket?? Because it basically comes down between you and the other driver. And insurance will decide who is at fault by the stories they get from you and the other driver.

If you have full coverage you will have to claim on your insurance. And then they should go after the other drivers insurance to cover the cost they had to pay out. But either way your paying the deductible if you file a claim with your insurance.
 
Paying your deductible is not an admission of fault. If you want your car fixed by your insurance company, you will need to pay the deductible. They will investigate the claim and subrogate the claim if they feel the other driver is at fault and get your deductible back. They should have explained that to you. Your only other option would be to contact the insurance company of the person who hit your car and see if they will pay for your damages, which will depend on the other person's version of what happened (in other words, did they admit fault). With that being said, accidents in parking lots are hard to investigate and given your account of the accident, I'd just deal with your insurance company. It's usually a "he said, she said" thing anyway and most of the time it's determined that both parties are equally at fault and responsible for the damages to their own cars.
 
Probably she was drunk - you should have called the cops, unless of course you were also a bit inebriated? Anyway, if you were in her lane, you lose.
 
That's never fun. Sorry to hear about that.

If you had a stop sign and she didn't, it is your fault and vice versa. If there was no stop sign for either of you but she was already travelling in that lane, it is your fault. It also depends on what state you live in whether it is a no-fault or tort state. That will determine how insurance looks at it. I'm assuming you got a police report. Get a copy, if you haven't already, and see what the officer said happened. That will make a big difference with the insurance company.

No one got tickets, cop said he couldnt tell who hit who so no ticket was issued

she was very elderly with a breathing problem, also it happen in a 1 way lane
 
get a quote to see how much to fix it. then talk to your insurance carrier and ask then if you submit the claim if your insurance will go up next year. One of my buddies had liability only, paid his deductible and next year his insurance went up.
