And therein lies the difference. I got caught by signing based on thorough initial inspection and only cursory second inspection looking for the most obvious damage that would have been expected, i.e., full-out cracking.

Your in bad water bro. They will all try to blame it on you. You have to do thorough exam before signing for it and then pray it doesn't leak when you fill it up! Don't give up

That is significant. Call a lawyer. I am not usually a proponent of that but this is clear cut.

I wish I had good news. But the only thing clear cut is that he signed saying it was 100% and the facility before him did. He broke it is all your going to hear !

Man I'm sorry for you losing your new tank to having a hi-low operator as incompetent as that. Best of luck with trying to continue the fight with them.

I had this happen last year. After posting a huge thread on here, the company decided to make and send me a new one. UPS will never honor a claim because you signed for it. As a side note, why did you UPS?

Coast to Coast arranged for it through a shipping broker they use.

And re hiring an attorney, I AM one. As noted before, I got "caught" by basing my signature in part on the initial inspection. And I don't intend to just walk away and forget about it. Yes, I know the facts re signature; I have argument I intend to present that is in line with the situation.

After a LOT of effort slicing through over 18 feet of seams 1.5 inches at a time (the width of a razor blade being pushed into the silicone), I managed to remove the bracing and will repair.

So sorry for what has happened. The tank is fixable?

Per CTC,

"Please note that when you removed the bracing it released natural pressure , by doing this we can not offer

You any Warranty on your Aquarium."

So even if I took the tank up to CTC for them to put new bracing on it, I still have to worry about integrity of the tank. Sigh.....

I got two TVs for a work project not to long ago. Both were smashed by UPS. Our regular guy said never have anything like that shipped by them.

Based on further information I've received and about which I will be posting elsewhere in dedicated thread, I now believe CTC was responsible for the bracing being chipped, and it's something I simply did not see when I inspected at the depot. I still believe UPS was negligent in how they handled the crate when loading it onto trailer, but I think fault for crappy looking bracing (fissures throughout the silicone between panels of the bracing, uneven wavy edges, AND the chips) lies squarely on CTC.
