Does anyone live in an HOA community?

No offense, but why someone would want to live on an 80 acre isolated farm is beyond me. Remember we are all different people and luckily do not all want to live in the same place. I would love living in this space, if the HOA would enforce some rules.

Agreed, to each his own. I've lived both the suburban life and farm life. Wouldn't give up what I have now for anything.
 
I've been to a lawyer. They recommended I sell and get the hell out, because it was such a mess. Things simmered down, but they are starting back up again.

Then sell soon. Interest rates look like they are going to be raised, and this will slow the market.

I can't. I'm not working and that would affect any new loan.

I'm cool with that, of course, or I wouldn't have moved in here. I have a problem with them doing nothing. If I want to address it, I need a lawyer. To pay for lawyers, one needs a job.

They have targeted me with a citation and I hope they truly realize what can of worms they've opened. If I have to move forward, I'm not going to an HOA lawyer, but an ADA lawyer. I'll be going for disability discrimination.

I hear you brother. My bro-in-law lived in The Villages. Close your garage door by 7PM or be fined. How often to fertilize your grass and who can do it. Give me a break! He moved.
 
If that was my problem, that would be so easy... obey the rules you signed up for when you moved in and it's problem solved. I wish someone would tell the guy next to me to water/fertilize his lawn. They just sold the place and they photoshopped his dirt patch green in the listing! I had to laugh.
 
I live in FL and live under a HOA, I wouldn't have it any other way. I prefer to live in a neighborhood without a neon orange house, or crap laying all over the front lawn. You pay to keep your home value up and the people who want to live like slobs have to move on. Works for me.

I too moved in here for the rules and what you have... problem is, I'm not getting that. The slobs are running the place. Three households that were a problem lost their homes this year, so it's better than it was. It's not the most problematic home, however.

That sucks, my HOA is still run by the builder so they can get pretty picky, but don't do much to enforce since there are still empty lots waiting to be built on (should be filled in 2 years or so). I plan to run to be on the board to make sure our neighborhood doesn't turn to crap, if you have board members that don't care, you might as well not have an HOA...
 
I too live in an HOA and I don't mind it one bit. I've worked really hard for all I have. I like it because the rules are clear and enforced. Everyone knows what's expected of them and it brings order to the community.

I've lived outside of one also and it wasn't a problem either. So the moral of the story is research your neighborhood before you buy.
 
Renee, I've created, developer managed and turned over numerous HOA's. Not sure how it is in Cali, but we have a state regulatory agency here that overseas HOA's and condo associations. You likely have the same thing there.

Do you have a management company that works for the HOA? Are they involved and active?

The association likely has an attorney that represents it. You need to solicit their advice on how to get things turned around. If they don't help, my recommendation is to contact the state agency and get them involved. I assure you that will get their attention.

It sounds to me you have a disfunctional board and the end game here is a new board. The problem is they haven't enforced anything thus far and that has to change, but should be done systematically to avoid having the association sued by an owner for "selective enforcement" for a lack of a better term.

Last question...are you willing to step up and serve on the board? What it takes is people that care about their neighborhood being willing to serve on the board. No pay for nothing but headaches is usually a pretty hard sale...lol!!!
 
They didn't even cite me for the right thing. They cited me (and only me) for being in a fire lane. I was parked outside of my house like everyone else. (no one else got a citation, I was the only one with a 11x7 adhesive note that I couldn't scrape off easily and was blocking me seeing out the windshield to move. They also cited me for not moving during street cleaning which no one has done for the 6 years I've been here. Things is, everyone else on the street during sweeping was not ticketed. Do they not think my video camera that says "smile your on camera" is just a hoax. I can prove that everyone was still on the road.

Thing is, to leave a ticket on my car, they have to pass by the picture below.... I guess they don't care about the disabled? At the same time they are citing (targeting) me for street sweeping, they are walkign past this vehicle... hmmmm.

This is part of what I had to say to that.

"Street sweeping, I agree, is an important part of keeping our community beautiful, but maybe we should also be concerned with keeping our community safe. When you come in and out of Monterey Pines, you have to pass by people parking in red zones where the curbs are cut away for handicap access. When those areas are blocked by cars, people who cannot step off/on the high curb have to walk in the street. Maybe our citations should include those types of infractions as well. I’m sure you’ll agree the safety of all of our residents is just as important as the beauty of the pavement. Please call on me, if there is anything I can do to help."

By the way Chris, if an HOA tells an owner they can't fly an American Flag, that owner can point a finger at them and raise Old Glory, at least here in Florida. No local association can prevent them from doing so, at least legally.

Nor can they prevent them from alternative power solutions (ie: solar panels). Don't ask me how I know...lol.
 
There's such a long history with this, it's not a simple solution. If I want to fully address it, I need a lawyer. California is different from a lot of states because of the Davis-Sterling Act. I was more than willing to step up... it's too long of a history to get into. We actually may not be legal. I can't even tell you the time and money I've put into this in the past.

I'm just commiserating... well, commiserating and waiting for Tuesday when the street sweeper comes. I'm moving out of the way and will be looking for tickets on every car that does not move. If they do not have tickets, I was targeted. Well, I already know I was targeted, as last week I was the only one with a ticket and a tow warning. No one else had it. I'll be video taping as the sweeper goes by and noting who was parked.

They also cited be for "storing" a vehicle. They are wrong though. It's insured, registered and there's only 2 cars in a 2 person household. I was simply parked. I'm waiting for them to pull out the 72-hour rule that the city has... BRING IT!!

We have one...all it does is maintain the neighborhood pool, park/playground and big fishing pond. Like 325.00 for the year.

But we have had issues, we closed on this place in april and the HOA was paid for the year by the previous owners course we refunded them at closing. So we move in, start getting letters from the HOA demanding money but the kicker is no names no emails no contact info for "them" at all Except a local PO box. (facepalm)
Double checked the paperwork...yup they where paid. Get another letter same thing send money, emailed the closing attorney yup they where paid. more letters....
I write them a letter, explain all this. provided All my contact info. Please contact me its been paid blah blah.
Get another letter they are talking leans, and contacting my mortgage company. Still no bloody way to actually talk to them.
So I send a check for 150.00 ... and they send a welcome the neighborhood! the membership card(for the pool gee could have used that this summer) my check uncashed back and a receipt for the full amount marked as paid on my closing day. (jerks)
 
We don't have any amenities, no pool or common grounds to hang at. We have a gate...

They rarely answer me back, so I don't really expect to hear much from them about the current situation.

I have to park one car on the street because of my disability, but it's also legal to park there, so I'm not breaking any rules. I have to be able to open up the door all the way and I back in to sit down, so if there's two cars in the driveway, I can't get in. They already know about my medical history.

Do I have hard feelings well yes I do. 200 a month and then being told I can't drive my truck home when I'm one of the few paying my dues. I sold my town home 72 hours after it hit the market and wood live in a tent before I'd go back. Now we have an acre and my neighbors are literally two jerks. Lol like the ones that eat grass. My advice is if you live in one run away very fast.
 
LOL! What is with all this business of recommending the sticks? Not exactly the direction I want to go in.
 
We have an HOA here. Before I moved here all I could think of were the nightmare stories that I've heard about them. Ours is about $250.00 for the year, so not bad at all. That takes care of the pools, beach, tennis courts, park, etc. that is part of the subdivision. They also have been helpful in kicking the rental riffraff out of here. The house across the street is rented out, and one of the tenants was a hoarder. Every time they opened the garage there was literally trash to the ceiling, and eventually said garbage started collecting in the front yard. The HOA was quick to tell the home owner to either have their tenant shape up or face a pretty hefty fine. The person was gone soon there after, so I take it as that was their way of taking care of the problem haha. I kind of feel bad for the person that actually owns the house across the street because their luck with tenants hasn't been so great, and they have had no luck selling it either. (Probably because we live across the street hahaha. Just kidding.)
