Native fish legal as pets and collecting

Are native fish (both freshwater and saltwater) legal to collect and keep as pets in aquariums with a fishing license?

In NY its not clear it is just assumed no although multiple people have them if it isnt legal then I will stick to both my tropical tanks but of course native fish are a cool cheap way for me to try new challenges.
