Got a bubble magus curve 5 new shipped with a bunch of scuff marks, should I ask for a replacement? Or is this type of thing normal?

New Orphek OR4 iCon LED Bars
that wouldn't concern me, as long as it isn't cracked.
 
What i see is O ring not set in adjustment tube,my guess is possibly used,returned ??
would def question.
