Will this sump design work properly for 40 gallon aquarium?

I tough about that but i think if i put refugium first all the beneficial invertebrates will get chopped up in the skimmer.
Only some of the water goes through the skimmer. I have a lot of pods in my chaeto and I don't get a lot of them in my skimmer cup. I guess they like to stay in the chaeto. What pods do get into my skimmer cup are not chopped up. I also believe that some pods get into my DT, fully alive, after passing through my return pumps.

The only things I'd add is to make sure that if your filter floss gets plugged with detritus there is a way for the water to continue to flow into the rest of the sump. Also make sure the baffle that sets your skimmer chamber height is appropriate for your skimmer, or that you have room to add a stand under the skimmer to raise it up.
