Nightmare Experience with Kigs!

FYI. I am curently in the process filling a claim against "Kigs" with Paypal and my credit card co. I ordered from him because he seemed to have good feedback. On 8/13/07 I paypaled him $257 for 13 of his listed 40 polyps. He charged a 2.9% paypal fee which I have since learned is against paypal rules.
8/25/07- Kigs says he will ship next Monday
8/26/07-doesn't ship says there was a death in the family
8/29/07-claims he will add in a "few freebies" due to delay
9/5/07- he returns from family matters. I send an additional $103 for 4 additional polyps.
9/6/07- says he will ship out on monday-doesn't ship
9/11/07- says he arrived too late to ship out next day guarenteed. Says he will ship next day.
9/12/07-package doesn't arrive
9/13/07- says he got in a car wreck. Agrees to add 4 polyps as a bonus for the delay. Needs a couple days for polyps to heal.
9/19/07- package arrives. Only 14 baggies w/ 1 polyp in each arrive. I should have recieved approx 20 w/ freebies. I asked for a cold pack due to TX heat. He sent them w/ a heat pack. 8 of the 14 polyps were detached from the plug (after a month of being fragged). Several of the polyps were stuck in the plastic not containing water. His packaging was extremely poor. The bags were placed in a carboard box with peanuts. No foam cooler for insulation. I requested that the frags be labled and none were. Photopgraphs were sent of his detached polyps still in the bag as well as the total of 14 bags. Only 6 polyps survived after a few days. I expressed concern about the health of what remained due to the extreme stress they endured. He corresponds saying that another order was sent out on that day. We discussed the possibility that the orders were switched. He stated that the other person seemed overjoyed by his generosity in the order. At the time he seemed very open to the possibility he switched the orders. He later retracted on this. I have no idea if he switched them all I know is my order was incopmlete. I was unable to recognize one of the polyps as anything I ordered. After another person publicly criticizes him for another transaction he agrees to work with me on the problem. He states that many of his polyps were not doing well and have a fungus. Just the other day he lists several polyps that are not available for replacement. Today I see that he is selling some of those very polyps on RC that he could not replace for me. I contacted him today and he stated that the coral being sold here is not his. He is selling these for another person who does not yet have enough posts. I notified Kigs today that I have filled a complaint against him. Buyer be extremely careful. I have photographs as well as all PMs and e-mails between the two of us to support my claims. I understand Kigs has given money in support of this site and some have had positive experiences with him. My experience has been terrible.

Andy, I was still willing to work something out with you untill you decided to act hasty and file a claim. Seeing that you have already taken all necessary steps, I see no further need to work with you and reach a compromise. I have had my share of dissatisfactions while listening to your case, but honestly, I'm tired of this drama. I'm sincerly sorry that we could not come to an agreement, I wish things could have turned out better.

How is waiting 2 mos. after paying you $350 acting hastily? I could have bashed you when you were being critcized several weeks ago but I chose no to. If you settle this matter in a professional manner I would be happy to retract my complaint. I took the step of filling a complaint b/c you have yet to make good on my order after 2 months.

As I have stated above, we were working on a compromise untill you threatened me with a claim and legal actions. Feel free to continue on with your complaint, I choose to disagree with your dissastisfaction since I have done everything in my power in terms of communication and figuring out to the last details of what will work for both of us. Now I'm feeling somewhat reluctant to do anything for you for obvious reasons. I hope you can understand where I'm coming from. I felt bad and I still do, but I'm not sure what the point is when you already have decided to contact the third parties for their opinion and chose describe me in such ridiculous words publicly. I will let them decide on this issue, which is what you surely had hoped for when you notified them.

I am protecting my hard earned money. I make a living as a clinical psychologist and base my work on honesty and integrity. I would not make this whole thing up as you have suggested in PMs. I contacted a 3rd party because of my feeling that you were being dishonest and not living up to your part of our agreement. I firmly believe I will be reimbersed by the credit card company. I would prefer that you refund my money at a prorated rate or send the coral I ordered. I think it will less of a hassle for both of us. If you choose to stop working on this issue that is your choice.

I posted feedback about Kigs at Reef Central and Nano Reef. It appears I am not the only one dissatisfied with him.

I'm confused Andy. It was your decision to stop working on this issue when you sent me a PM notifying me that you are contacting third parties out of the blue. Upto that point, we have been exchanging PMs back and forth trying to figure out a middleground, have we not? And by middleground, I mean I was willing to replace your entire order with new ones. As I have told you in the PM, it was your choice to give me an option of replacements. I complied and worked diligently in replying to your PMs and staying in touch with you. This time, it was also your choice to settle this issue in another way. I respect that, and I will also comply this time but it is now out of my hands and can no longer work with you on a personal level. I will continue to apologize that we could not come to a satisfying agreement on this matter, but I assure you I was not being dishonest and I was living upto every part of our agreement.

I was only willing to look at other options when you told me the polyps I ordered were unavailable due to a fungus in your tank. Today you are selling the very polyps you recently stated were unavailable. This issue can be resolved with a pro-rated refund or by you sending me the correct order. I also expect you to refund me the 2.9% charge you added for paypal which is against their rules. I notice you have not commented on this rule violation.

I quoted it again for you just in case you didn't read your own words. Did you already forget the reason why you even began this thread in the first place?

Today I see that he is selling some of those very polyps on RC that he could not replace for me. I contacted him today and he stated that the coral being sold here is not his. He is selling these for another person who does not yet have enough posts.

Paypal? Do you think it is ethical to sell something as yours when it is not. I also find it interesting how similar your "friends" sale is to ones you have done in the past. The reason the site makes you have a certain number of posts prior to selling is for quality control. Do you feel entiltled to bend this rule to meet your needs?

Obviously I cannot invite you over to see for yourself, but I'm hoping you will extend the same courtesy to me as I have done for you. Also, please save your RC-regulation police activities for some other time. You are digressing.

Actually you have not been very trusting throughout this process. You actually appeared a bit paranoid. You seem to like to tell people they are "taking advantage of a situation" anytime someone complains (an example may be made available upon request. If you were so flexible as you wish to appear you would have sent my order or paid me back a long time ago.

Paranoid? Again, save your e-psychoanalysis on me for some other time. I'm not one of your patients. I can remember saying that phrase once, but feel free to apply it anywhere you seem fit. As for your last comment,

A person from RC shared this..."If you are ordering from this poster, be aware that you probably won't get them when he says you will, and you might not get them at all. I bought a frag of some favia from him that was supposed to be sent overnight.....week and a half later i received a refund due to "the frag didn't do to well." "

Then why sell it in the first place and offer overnight delivery if its not ready to ship out?

Just my 2 cents.

I think you forgot to quote my response to that post. I'm not sure why the child decided to complain since I did the right thing by not sending out a frag when I was not comfortable sending out due to its poor health, not to mention a full refund. Just another spoiled kid with his parents CC, complaining about not getting what he wanted and I have his PMs to prove his behavior. Maybe you can analyze his words and give me a more accurate analysis? Quoting something as idiotic as that doesn't even deserve to be added onto your case. Sorry, again you continue to bounce from point to point, not choosing to respond to any of my concerns.

My other clients...lol It was their choice to pay whenever I asked. When I did ask, I was never aware that it was against the paypal policy and if I knew, I wouldn't have asked. To me, it was always regarded as a courtesy and I've tried to make up for it with a freebie for shipping and the fee. ;) Your persistence on this issue is interesting, but I've already refunded you the fee. You go all over the board trashing my name and contacting third parties for a resolution, but you insist on asking me to play a role in this situation. It is now out of my hands Andy, let paypal and your CC take care of it. I've lost all interest in doing anything for you. I was willing to do everything for you upto this point, and out of all people you should know this. We'll let them settle this since that's what you wanted. Your questions and my answers are becoming somewhat repetitive, so stop asking the same questions.

When you sell someone $350 worth of goods you are selling to a client. Do you lie to refer to them as your "friends." Have you ever worked in the real world or do you just practice antisocial behavior to pay your bills?

hi andy I am not taking sides here but that 2.9% fee is what the seller gets charged by paypal to recieve the money that way I have never said I was going to charge extra for use of paypal but it is the sellers right to charge whatever they want and that includes a "handling" fee that would be all emcompasing for that extra 2.9% and any shipping and packing materials then shipping is ontop of the handling charge

also I would like to see a link to this rule saying you cant charge a buyer the extra to recoop what paypal chages you as I have never seen this

either way i think from reading this thread that both of you have some shady dealings and neither are beeing compleatly honest and with how andy keeps bouncing all over trying to scrape one or two bad instances with other buyers tells me that he might be just trying to get some extra free corals

IMO best way to resolve is to simply refund the cost of the corals that didn't get shipped and also to prove you didn't recieve the corals pics should be taken listing the corals ordered and corals recieved
